Terms of Service

These terms govern your use of the Barakah Ummah Fund website and services ("the Fund", "we", "us"). By giving, following a mosque, or creating an account, you agree to them. If you do not agree, please do not use the service.
1. Who can use the Fund
You must be old enough to enter a binding agreement where you live, and to operate the mobile-money or bank account you give from. By using the Fund you confirm the funds you give are lawfully yours and lawfully obtained.
2. Signing in and your account
You can sign in with your phone number (a one-time code) or with your Google account. No passwords are used. Your phone number is your primary identity for receipts and mosque records; keep access to it secure, as anyone with your phone and its verification code can reach your account. Tell us promptly if you suspect unauthorised access.
3. Giving — how donations work
You may give a recurring weekly ("Jummah") amount by dialling a USSD code, or a one-time or Waqf (endowment) gift via our payment partner. When you set up a gift you authorise the corresponding charge to your chosen mobile-money or bank instrument. You are responsible for the amount, the fund or mosque you select, and any fees your provider charges.
You can cancel a recurring instrument at any time from your giving history; cancellation stops future charges but does not reverse gifts already made.
4. Gifts are generally final
Donations are charitable gifts given for the sake of Allah and are, as a rule, non-refundable once received and allocated to a fund. If a genuine error occurs — a duplicate charge, a clearly mistaken amount, or a technical fault — contact us at hello@barakahummah.org promptly and we will review it in good faith. Approved corrections are returned to the original payment method where possible.
5. The four funds and Shari'ah governance
The Fund operates four ring-fenced pools — Waqf, Sadaqah/Zakat, Mudarabah, and Qard Hasan. We operate on Shari'ah principles: the Waqf principal is preserved and never spent; interest (riba) does not enter the system; and no disbursement is made without the approval of the Shura Board. Fund balances and approved disbursements are published on the transparency dashboard.
We apply your gift to the fund or mosque you select. Where a selection is unavailable or a project is already fully funded, the Shura Board may direct the gift to the nearest comparable Shari'ah-compliant use.
6. Mosques and collection agents
You may register a mosque, which becomes visible only after committee approval. Collection agents act on behalf of their mosque committee; cash they log is recorded against that mosque. Provide accurate information when registering or logging on behalf of others.
7. Acceptable use
Do not use the Fund to launder money, to give funds that are not lawfully yours, to impersonate others, to disrupt or probe the service, or for any unlawful purpose. We may suspend accounts or reverse activity that breaches these terms or that we reasonably believe to be fraudulent.
8. Third-party services
We rely on third parties — including our payment provider (Monime), Google (sign-in), and a push-notification provider — to deliver the service. Your use of those features is also subject to their terms. We are not responsible for outages or acts of those providers beyond our control.
9. No warranty; limitation of liability
The service is provided "as is" without warranties of any kind. To the extent permitted by law, the Fund and its trustees are not liable for indirect or consequential losses, or for losses arising from provider outages, network failures, or your own account security. Nothing here limits liability that cannot lawfully be limited.
10. Changes to these terms
We may update these terms as the Fund grows or as governance and law require. Material changes will be announced on this page with a new "last updated" date. Continuing to use the service after a change means you accept it.
11. Governing law
These terms are governed by the laws of Sierra Leone, and by the Shari'ah principles under which the Fund is constituted. Disputes will first be pursued amicably and, where relevant, through the Shura Board, before any formal proceedings.
